FIRPTA Cases: Foreigners Selling U.S. Real Estate

Under IRC § 1445, buyers of U.S. real estate from a foreign seller must withhold 15% (or 10% for qualifying residential transactions) of the gross sales price—which almost always exceeds the actual tax owed on the net gain. We work directly with foreign sellers and title/escrow officers to prepare Form 8288-B (Application for Withholding Certificate) prior to closing, coordinate Forms 8288 & 8288-A escrow transmittals, certify Form W-7 (ITIN) applications, and file nonresident U.S. tax returns to claim excess FIRPTA refunds.
